The Money Arrives at the Worst Possible Moment
Somewhere to stay, replacing what burned, transport, time off work, and a family that needs things. Those are real and immediate, and the insurance cheque is the only money in the room.
Under section 70(3) the trust commences when any asset of it comes into existence, whether or not there is at that time any beneficiary. So the character attaches on arrival, before any of those pressures have been resolved. The framework is on our page covering the trust and the records.

Section 75(4) provides that failure to keep the books or records required by the section is presumptive evidence that trust funds were applied for purposes other than a trust purpose. The absence of records is the part of that sentence you control, and it costs nothing to fix.

Repair costs what the trades charge regardless of neighbourhood, and across much of the northeast and northwest a full repair approaches the finished value.
The one advantage is the housing. Dimensional timber of this era chars on the surface rather than failing at connections, so members can frequently be assessed, cleaned back and retained. That lowers the cost of repair enough, sometimes, to make it viable at all.
Secure It Before the Freeze
Water entering charred timber freezes, expands and thaws repeatedly through a Rochester winter, and a frame retainable in autumn frequently is not by spring. Securing costs a fraction of repairing and is the only item that gets more expensive by waiting.

The Sections That Govern the Money
Article 3-A of the Lien Law runs from section 70 to section 79-a. Section 70(2) makes the owner the trustee, section 70(3) starts the trust when an asset comes into existence, and section 70(5)(f) brings fire insurance proceeds inside it.
Section 71 defines the trust purposes, section 75 requires the records, and section 79-a(1)(b) sets a 31 day limit for paying a trust claim in the contracting chain.
