What Does a Long Wait Actually Risk?

Two things at once. The building deteriorates through winters it did not need to face, and a settlement sitting in an ordinary account for eight months is a settlement that gets dipped into. Neither is a decision anybody makes; both are what happens when a file is in a holding pattern nobody set. Keeping the money identifiable and the building covered are the two responses, and both are cheap.

Fewer Contractors Changes the Bargaining

Where a builder can fill their book without you, the terms tend to favour them, and a larger deposit is more likely to be asked for.

That is a reason to be more rather than less careful about what a payment is for and what evidence you hold that it was applied to the work. Lien waivers as payments are made are worth asking for even on modest jobs here.

Should I Use a Rochester Contractor Instead?

The Sections That Do Not Change By County

Article 3-A of the Lien Law, sections 70 to 79-a, applies throughout New York. Section 70(3) starts the trust when an asset comes into existence, whether or not there is then any beneficiary, and section 70(5)(f) brings fire proceeds inside it.

Section 75 requires the records, section 75(4) makes their absence presumptive evidence, and section 79-a(1)(b) sets 31 days for paying a trust claim in the contracting chain.
